Experienced Houston Property-Division Lawyer

The division of property in Texas can be complex. Two underlying questions must be answered before property may be divided:

  • Classification: Is the property community (marital) property or separate property?
  • Valuation: How much is the property worth?

Once these questions are answered, the court will examine several factors to determine the most equitable distribution of the community property, including:

  • Age
  • Education
  • Work experience
  • Health
  • Special needs
  • Conduct of the parties (e.g., fraud)
  • Earning capacity
  • Separate property

Classification

Property is classified depending on whether it was owned before the marriage, was a gift or inheritance, or was acquired after the separation or divorce. Property accumulated or acquired during the marriage is considered community property. Classification becomes more complex when separate property is commingled with marital property.

For example, complex issues arise if a home or property was brought into a marriage but all or part of the property was paid for during the marriage or if improvements were made during the marriage.

Valuation Issues

Valuation issues can be complex when the property in question is one for which it is difficult to attain a fair market value (e.g., professional businesses, minority shareholders, stock options, insurance policies, pension plans, collectibles).

Whether you have a classification issue or valuation issue, we put more than 20 years of experience to work for you. We also have an extensive network of actuaries and professionals to help us resolve your issue.

The division of property in Texas is too important to trust to a less-experienced attorney; your future and livelihood depend on the outcome.
